- On January 1,1994, the Brokerage Relationships
in Real Estate Transactions Act (BRETTA) became law in the state of
Georgia. This Act clarifies relationships between brokers, buyers
and sellers. BRETTA calls for full disclosure of the working
relationships and legal obligations between Agents and their Clients or
Customers.

- Agents are now required by state law to
disclose to you who they are working for. This disclosure should
take place early in your relationship with the Agent. The Agent may
work for: the buyer, the seller or no-one. Dual Agency is another
form of representation when an Agent has a formal signed agreement with
both the buyer and seller, and the agent is representing both parties in
the sale of the same home. This form of agency can only exist with
disclosure to, and permission of, all parties involved in the real estate
transaction.
